Landmark equal pay claim win may lead to job cuts at Bury Council


WORKERS at Bury Council could face “wholesale” job cuts to meet the cost of reimbursing 1,200 female staff who have won a landmark equal pay claim case.

The grim warning has come from chief executive Mark Sanders days after Manchester employment tribunal’s ruling virtually paved the way for the women to receive thousands of pounds each.

“The Government needs to consider if it would allow us borrowing approval. If we don’t get that borrowing, potentially we’re bankrupt.

Their union, Unison, fought and won the equal pay claim against Bury Council during a four-week hearing.

The council’s claim that the men were paid more because of a genuine material factor, rather than because of the workers’ sex, was rejected.

And the Manchester tribunal has ruled that the women - who include cleaners, support workers and cooks - will now earn bonus payments of between 33.33 per cent and 50 per cent in line with male colleagues such as refuse collectors, labourers and gardeners.

But with the spectre of the local authority facing a huge cash bill running into millions of pounds, bosses have warned that jobs will have to be axed as a consequence of settling the claims.

Mr Sanders told the Bury Times: “The Government needs to consider if it would allow us borrowing approval. If that is the case, we will need to have room in the budget to pay back that borrowing.

“If we don’t get that borrowing, potentially we’re bankrupt. If we do get it, we’ll have to pay it back and have to create room to pay it back. With no room in our budget, there will have to be wholesale cuts to jobs. It’s an appalling scenario.”

In the meantime, however, council chiefs say they are “disappointed” with the result of the tribunal because they believed they were taking the “correct action” in defending the claims. Now, together with legal counsel, Bury Council will study the verdict in detail and examine its options, including whether to lodge an appeal.

Wasn't it only a few months ago that Bury MBC announced pay cuts for employees earning under £47k pa?

Perhaps Mr Sanders would consider a pay cut to his not inconsiderable salary and also look to the jobs that attract salaries of £47k plus to see where REAL savings can be made. The problem with Greenmount's suggestion that only one job cut needed is that it will only be filled again. Mr Sanders needs to sort this mess out by leading from the front.

I shall not be holding my breath.

If we don’t get that borrowing, potentially we’re bankrupt.im sorry, I always thought that if you took a job with poor pay and little prospects and didnt bother trying to apply for a better one that the blame for the state of your financial situation was with you. apparently not, its Bury Council's tax payers problem. thanks to this ruling and the previous pay and grading disaster, the gap between pay for unskilled and professional jobs at the council has all but vanished.

theres a great many people at the council who have given up a great deal of their own time to get the qaulifications the councils needs them to attain to provide a service the people of Bury. The events of the last year or so make me wonder why we
bothered.pushing a brush round sounds much less stressful than providing a front line service.

Stressful? You try preparing a meal and serving it to 200 children in under an hour...or is that not "front line" enough for you?
Many "girls" working in the school meals service are as well qualified as anybody providing a service to the people of Bury, unfortunately for us all they didn't know that their employer was ripping them off in order to pay for the non-jobs that are prevalent throughout the Council.
Do you know that the "Lead Parenting Commissioner for Bury" ensuring "the third sector's engagement is maximised" and coordinating the work of the "Change for Children subgroup of Bury's Children and Young People's Trust" gets £35K a year?

If we don’t get that borrowing, potentially we’re bankrupt.Well done to council workers , for winning ,sticking with it and standing up for what is right, there would have been more in the 'pot' had the council did the right thing and paid workers from the onset, and they may now consider wasting more money on legal fees on an appeal!!!! winning should prompt other councils up and down the country to cut the chase and pay the workers.

I am pleased to say that I do not have the misfortune of working for Bury Council. The fact that they thought it reasonable to spend funds which it is claimed they do not have to fight this equal pay claim is shocking. If as claimed they spent half a million pounds hiring a lawyer to fight their case, would that not have been put to better use paying the staff what they are owed. I am obviously extremely naive to think those at the top of the council should take responsibility for the mess our Council is in.

Why does the Council insist on putting (our) money the way of solicitors when their employees are out of pocket? Where do their priorities lie?

If we don’t get that borrowing, potentially we’re bankrupt.The coucil was offered on many many occasions to pay what is owed but thought they were above the law and different o the rest of the country.Why is money being wasted on changing Logos etc.Make the woman their offers and use the money they got back on the bad banking error from years ago.If jobs are to be cut then start at the top.

If there are to be any redundancies as a result of this award then they should start at the very top with Mr Sanders the first to go,after that, every other top manager should have their pay cut by30% or whatever it takes to recover the re-payments.
There should be no job losses whatsoever of any front line workers. The people who took the crazy decision to contest this should be the ones that are made to pay.
I am not,& never have been a council employee, just an angry council tax payer.
